S.B. No. 1490         AN ACT   relating to the premium surcharge certain automobile insurers are   required to assess against an insured convicted of certain   offenses.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 1953.052(a), Insurance Code, is amended   to read as follows:          (a)  An insurer described by Section 1952.001 shall assess a   premium surcharge in an amount as stated in the insurer's rating   plan [prescribed by the department] against an insured for no more   than three years immediately following the date the insured is   convicted of:                (1)  an offense relating to the operating of a motor   vehicle while intoxicated in violation of Section 49.04 or 49.07,   Penal Code; or                (2)  an offense under Section 49.08, Penal Code.          SECTION 2.  This Act takes effect September 1, 2017.             ______________________________ ______________________________      President of the Senate Speaker of the House                 I hereby certify that S.B. No. 1490 passed the Senate on   April 26, 2017, by the following vote:  Yeas 31, Nays 0.       ______________________________   Secretary of the Senate                I hereby certify that S.B. No. 1490 passed the House on   May 19, 2017, by the following vote:  Yeas 144, Nays 0, two   present not voting.       ______________________________   Chief Clerk of the House            Approved:     ______________________________                Date       ______________________________              Governor
