85R3328 SLB-D     By: Kolkhorst S.B. No. 546       A BILL TO BE ENTITLED   AN ACT   relating to the quality of water provided by public drinking water   supply systems to state supported living centers.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter B, Chapter 555, Health and Safety   Code, is amended by adding Section 555.026 to read as follows:          Sec. 555.026.  DRINKING WATER QUALITY:  COOPERATION WITH   TEXAS COMMISSION ON ENVIRONMENTAL QUALITY. To ensure the quality   of water provided by public drinking water supply systems to state   supported living centers, the department or its successor agency,   in cooperation with the Texas Commission on Environmental Quality,   shall:                (1)  develop:                      (A)  a testing plan and monitoring strategy;                      (B)  outreach and educational materials for   distribution to residents and department staff;                      (C)  requirements for laboratory accreditation   and sample chain of custody procedures; and                      (D)  guidance for compliance with the federal lead   and copper rules (40 C.F.R. Part 141, Subpart I);                (2)  review:                      (A)  public notification procedures to staff,   residents, and visitors regarding water quality;                      (B)  sampling protocols and procedures;                      (C)  locations of taps used for monitoring;                      (D)  noncompliant lead and copper analytical   data;                      (E)  remediation activities; and                      (F)  customer service inspection reports;                (3)  compile a list of qualified customer service   inspectors; and                (4)  perform:                      (A)  on-site training and evaluation of sampling;   and                      (B)  on-site evaluation of customer service   inspections.           SECTION 2.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution.  If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect September 1, 2017.
