No. 2427 By: Hinojosa of Hidalgo A BILL TO BE ENTITLED AN ACT relating to the issuance of and fee for a permit for the movement of oversize and overweight vehicles on certain routes in Hidalgo County and the use of those fees for the payment of the costs of constructing and maintaining certain of those routes. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 623.363, Transportation Code, is amended by amending Subsection (a) and adding Subsections (a-1) and (c) to read as follows: (a) The commission may authorize a regional mobility authority to issue permits for the movement of oversize or overweight vehicles carrying cargo in Hidalgo County on: (1) [the following roads: [(A)] U.S. Highway 281 between its intersection with the Pharr-Reynosa International Bridge and its intersection with State Highway 336; (2) [(B)] State Highway 336 between its intersection with U.S. Highway 281 and its intersection with Farm-to-Market Road 1016; (3) [(C)] Farm-to-Market Road 1016 between its intersection with State Highway 336 and its intersection with Trinity Road; (4) [(D)] Trinity Road between its intersection with Farm-to-Market Road 1016 and its intersection with Farm-to-Market Road 396; (5) [(E)] Farm-to-Market Road 396 between its intersection with Trinity Road and its intersection with the Anzalduas International Bridge; (6) [(F)] Farm-to-Market Road 2061 between its intersection with Farm-to-Market Road 3072 and its intersection with U.S. Highway 281; (7) [(G)] U.S. Highway 281 between its intersection with the Pharr-Reynosa International Bridge and its intersection with Spur 29; (8) [(H)] Spur 29 between its intersection with U.S. Highway 281 and its intersection with West Doffing [Doffin Canal] Road; (9) West Doffing Road between its intersection with Spur 29 and its eastern intersection with Doffin Canal Road [(I) Doffin Canal Road between its intersection with the Pharr-Reynosa International Bridge and its intersection with Spur 29]; (10) [(J)] Farm-to-Market Road 1015 between its intersection with U.S. Highway 281 and its intersection with U.S. Highway 83 Business; (11) [(K)] U.S. Highway 83 Business between its intersection with Farm-to-Market Road 1015 and its intersection with South Pleasantview Drive; (12) [(L)] Farm-to-Market Road 1015 between its intersection with U.S. Highway 83 Business and its intersection with Mile 9 Road North; [and] (13) [(M)] Mile 9 Road North between its intersection with Farm-to-Market Road 1015 and its intersection with Joe Stephens Avenue; or (14) 365 Tollway between its intersection with Farm-to-Market Road 396 and its intersection with West Military Highway at San Juan Road [(2) another route designated by the commission in consultation with the authority]. (a-1) The authority authorized under this section shall pay from fees collected by the authority under Section 623.364 all costs to construct and maintain the route designated under Subsection (a)(9), and any off-system road designated after September 1, 2025. (c) The authority authorized under this section may not issue a permit under this section for an oversize or overweight vehicle that is transporting in a cargo tank hazardous material in a quantity requiring placarding by a regulation issued under the Hazardous Materials Transportation Act (49 U.S.C. Section 5101 et seq.). SECTION 2. Section 623.364(a), Transportation Code, is amended to read as follows: (a) The authority may collect a fee for permits issued under this subchapter. Beginning September 1, 2025 [2017], the maximum amount of the fee may not exceed $250 [$200] per trip. On September 1 of each subsequent year, the authority may adjust the maximum fee amount as necessary to reflect the percentage change during the preceding year in the Consumer Price Index for All Urban Consumers (CPI-U), U.S. City Average, published monthly by the United States Bureau of Labor Statistics or its successor in function. SECTION 3. (a) Except as provided by Subsection (b) of this section, this Act takes effect September 1, 2025. (b) This Act takes effect only if S.B. 2949, 89th Legislature, Regular Session, 2025, is enacted and becomes law. If legislation described by this subsection is not enacted or does not become law, this Act has no effect. * * * * *
