AMENDMENT IN THE NATURE OF A SUBSTITUTE
\r\n\r\n

Directing the Joint Legislative Audit and Review Commission to\r\nstudy the condition and capacity of the Hiram W. Davis Medical Center to\r\nprovide skilled nursing, long-term care, and community care services for\r\nindividuals diagnosed with intellectual or developmental disabilities within\r\nthe Commonwealth. Report.
\r\n\r\n
WHEREAS, the Southside Virginia Training Center, Northern\r\nVirginia Training Center, Southwestern Virginia Training Center, and Central\r\nVirginia Training Center have all closed permanently within the past nine\r\nyears; and
\r\n\r\n
WHEREAS, according to the 2022 population estimates by the\r\nUnited States Census Bureau, 8.3 percent of Commonwealth residents are younger\r\nthan 65 and have a disability; and
\r\n\r\n
WHEREAS, the Hiram W. Davis Medical Center, a 94-bed medical\r\nand long-term care facility in Petersburg, is one of nine behavioral health\r\nfacilities for adults operated by the Department of Behavioral Health and\r\nDevelopmental Services and was built in 1974 and has had no major renovations\r\nsince its construction; and
\r\n\r\n
WHEREAS, access to skilled nursing, long-term care, and\r\ncommunity care by individuals diagnosed with intellectual or developmental\r\ndisabilities facilities depends on the condition and capacity of facilities\r\nsuch as the Hiram W. Davis Medical Center; now, therefore, be it
\r\n\r\n
RESOLVED by the House of Delegates, the Senate concurring,\r\nThat the Joint Legislative Audit and Review Commission be directed to study the\r\ncondition and capacity of the Hiram W. Davis Medical Center to provide skilled\r\nnursing, long-term care, and community care services for individuals diagnosed\r\nwith intellectual or developmental disabilities within the Commonwealth.
\r\n\r\n
In conducting its study, the Joint Legislative Audit and\r\nReview Commission shall (i) determine the need for long-term care for\r\nindividuals diagnosed with intellectual or developmental disabilities in the\r\nCommonwealth; (ii) estimate the current capacity of the Hiram W. Davis Medical\r\nCenter to provide skilled nursing, long-term care, and community care services\r\nfor individuals diagnosed with intellectual or developmental disabilities\r\nwithin the Commonwealth; (iii) examine the current condition of the\r\ninfrastructure of the Hiram W. Davis Medical Center; (iv) provide\r\nrecommendations for increasing the capacity and updating the infrastructure of\r\nthe Hiram W. Davis Medical Center; (v) estimate the current capacity of\r\ncommunity-based services for meeting the long-term care needs of these\r\nindividuals; and (vi) provide recommendations for alternatives to\r\nfacility-based care.
\r\n\r\n
All agencies of the Commonwealth shall provide assistance to\r\nthe Joint Legislative Audit and Review Commission for this study, upon request.
\r\n\r\n
The Joint Legislative Audit and Review Commission shall\r\ncomplete its meetings by November 30, 2025, and the chairman shall submit to\r\nthe Division of Legislative Automated Systems an executive summary of its\r\nfindings and recommendations no later than the first day of the 2026 Regular\r\nSession of the General Assembly. The executive summary shall state whether the\r\nJoint Legislative Audit and Review Commission intends to submit to the General\r\nAssembly and the Governor a report of its findings and recommendations for\r\npublication as a House or Senate document. The executive summary and report\r\nshall be submitted as provided in the procedures of the Division of Legislative\r\nAutomated Systems for the processing of legislative documents and reports and\r\nshall be posted on the General Assembly's website.

WHEREAS, the Southside Virginia Training Center, Northern \r\n Virginia Training Center, Southwestern Virginia Training Center, and Central \r\n Virginia Training Center have all closed permanently within the past nine \r\n years; and
\r\n \r\n \n
WHEREAS, according to the 2022 population estimates by the \r\n United States Census Bureau, \r\n 16.9 percent of Commonwealth residents are 65 years old or older and 8.3 percent of Commonwealth residents are younger than 65 and have a disability; and
\r\n \r\n \n
WHEREAS, according to an October 2023 survey by the Virginia \r\n Health Care Association-Virginia Center for Assisted Living, 44 percent of 170 nursing home and assisted living \r\n providers surveyed have had a hold on admissions at least once since June 1, \r\n 2023, and 39 percent of providers surveyed maintain \r\n a waiting list for new admissions; and
\r\n \r\n \n
WHEREAS, the Hiram W.
