85R7083 AJZ-F     By: Geren, Rinaldi H.B. No. 1244       A BILL TO BE ENTITLED   AN ACT   relating to registration or transfer of title of a motor vehicle   alleged to have been involved in a violation detected by a   photographic traffic signal enforcement system.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 707.017, Transportation Code, is amended   to read as follows:          Sec. 707.017.  REGISTRATION OR TRANSFER OF TITLE AFTER   NOTICE OF VIOLATION ISSUED [ENFORCEMENT]. (a) Neither the [If the   owner of a motor vehicle is delinquent in the payment of a civil   penalty imposed under this chapter, the] county assessor-collector   nor [or] the Texas Department of Motor Vehicles may refuse to   transfer the title of or register a motor vehicle alleged to have   been involved in a [the] violation of this chapter solely:                (1)  based on the alleged violation; or                (2)  because the owner of the motor vehicle is   delinquent in the payment of a civil penalty imposed under this   chapter.          (b)  A local authority or the person with which the local   authority contracts for the administration and enforcement of a   photographic traffic signal enforcement system may not provide   information about a violation of this chapter to a person   authorized to register or issue a title for a vehicle under Chapter   501, 502, or 520. [This section does not apply to the registration   of a motor vehicle under Section 501.0234.]          SECTION 2.  Section 707.017, Transportation Code, as amended   by this Act, applies only to a civil penalty imposed under Chapter   707, Transportation Code, on or after the effective date of this   Act. A civil penalty imposed before the effective date of this Act   is governed by the law in effect when the civil penalty was imposed,   and the former law is continued in effect for that purpose.          SECTION 3.  This Act takes effect September 1, 2017.
