89R3681 KSD-F     By: Gervin-Hawkins H.B. No. 801       A BILL TO BE ENTITLED   AN ACT   relating to the application for funding for certain workforce   development programs.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter C, Chapter 302, Labor Code, is   amended by adding Section 302.0465 to read as follows:          Sec. 302.0465.  DIRECT FUNDING APPLICATION. (a) The   commission shall adopt a plan to allow nonprofit service providers   to apply for funding directly from the commission if the local   workforce development board is nonresponsive.  A local workforce   development board is considered nonresponsive if, as determined by   the commission, the board:                (1)  is not fulfilling the board's statutory   requirements; and                (2)  has not met at least 80 percent of the performance   standards established under this chapter and other applicable   federal and state law for two consecutive program years.          (b)  The plan adopted under this section may include an   application for funding for:                (1)  job training programs funded under the Workforce   Innovation and Opportunity Act (29 U.S.C. Section 3101 et seq.);                (2)  postsecondary vocational and technical job   training programs that are not part of approved courses or programs   that lead to licensing, certification, or an associate degree under   Chapter 61, 130, or 135, Education Code, or Subchapter E, Chapter   88, Education Code;                (3)  adult education programs under Chapter 315;                (4)  employment services programs;                (5)  support services provided for recipients of   financial assistance under Chapter 31, Human Resources Code; and                (6)  employment and training programs for recipients of   supplemental nutrition assistance under Chapter 33, Human   Resources Code.          SECTION 2.  As soon as practicable after the effective date   of this Act, the Texas Workforce Commission shall adopt the rules   necessary to implement Section 302.0465, Labor Code, as added by   this Act.          SECTION 3.  This Act takes effect September 1, 2025.
