89R16781 AJZ-F By: Morales of Maverick H.B. No. 5358 A BILL TO BE ENTITLED AN ACT relating to the issuance of a disabled parking sticker by the Department of Motor Vehicles. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 681.001, Transportation Code, is amended by adding Subdivision (3-a) to read as follows: (3-a) "Disabled parking sticker" means a sticker issued under Section 681.002. SECTION 2. The heading to Section 681.002, Transportation Code, is amended to read as follows: Sec. 681.002. DISABLED PARKING PLACARD OR STICKER. SECTION 3. Section 681.002, Transportation Code, is amended by amending Subsections (a), (c), and (d) and adding Subsections (f), (g), and (h) to read as follows: (a) The department shall provide for the issuance of a disabled parking placard or a disabled parking sticker, as provided by Subsection (f), to a person with a disability. (c) The department shall furnish the disabled parking placards and disabled parking stickers to each county assessor-collector. (d) A disabled parking placard and a disabled parking sticker must bear a hologram designed to prevent the reproduction of the placard or sticker or the production of a counterfeit placard or sticker. (f) If issuing a disabled parking placard is not feasible or practical, including when a person with a disability applies for a placard for a motor vehicle with two or three wheels, the department shall provide for the issuance of a disabled parking sticker in lieu of a placard. The disabled parking sticker must be one-sided and include the same information as a disabled parking placard under Subsections (b) and (e). The department shall adopt rules as necessary to implement this subsection. (g) A disabled parking sticker issued under Subsection (f) must be displayed on the top or bottom left hand corner of a motor vehicle's windshield. (h) Except as otherwise provided by this section, a disabled parking sticker is subject to the laws of this state applicable to a disabled parking placard, including laws relating to the application for and issuance of a disabled parking placard. SECTION 4. This Act takes effect September 1, 2025.
