Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 21.1, article 2, Arizona Revised Statutes, is amended by adding section 36-2248, to read:
START_STATUTE36-2248. Private ambulance services; nonemergent interfacility ambulance transportation; hours-of-service limit; rules
The department shall adopt rules that limit the hours of service for emergency medical responders who provide nonemergent interfacility ambulance transportation and who are employed by a private ambulance service as follows:
1. A maximum of twelve hours of driving time with twelve consecutive hours of off-duty time.
2. An individual may not drive after thirty-six hours on duty in any three-day period. An individual must take at least thirty-six consecutive hours off duty before restarting a consecutive three-day period on duty.
3. An individual may not drive after forty-two hours on duty in any five-day period. An individual must take at least forty-eight consecutive hours off duty before restarting a consecutive five-day period on duty.
4. A crew must take a thirty-minute break when it has been on duty for a period of eight consecutive hours without at least a thirty-minute interruption. The break may be satisfied by any nondriving period of thirty consecutive minutes without radio traffic or posting requirements. A crew may not be required to be inside the ambulance during the thirty-minute break. END_STATUTE
Sec. 2. Rulemaking exemption
Notwithstanding any other law, for the purposes of this act, the department of health services is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act.
