AN ACT

 

Amending Title 32, chapter 18, article 3, Arizona Revised Statutes, by adding section 32-1965.01; relating to the Arizona state board of pharmacy.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 32, chapter 18, article 3, Arizona Revised Statutes, is amended by adding section 32-1965.01, to read:

START_STATUTE32-1965.01. Pharmacies; off-label use; refusal prohibited; definition

A. During a proclaimed public health state of emergency, A pharmacy may not refuse to fill a prescription order for a prescription-only drug that is being prescribed for an off-label use and that is potentially life saving.

B. For the purposes of this section, "off-label use" has the same meaning prescribed in section 32-1997. END_STATUTE
