HOUSE BILL 2067
An Act
amending title 15, chapter 3, article 3, Arizona Revised Statutes, by adding section 15-341.02; relating to education records.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 3, article 3, Arizona Revised Statutes, is amended by adding section 15-341.02, to read:
START_STATUTE15-341.02. School district governing board members; school district information and records; access; confidentiality
A. for the purpose of carrying out the official functions and duties OF A SCHOOL DISTRICT GOVERNING BOARD, Each member of the school district governing board may access all information and records that are maintained by the school district.
B. On receipt of a request for information or records from a member of a school district governing board, An ADMINISTRATOR, OFFICIAL OR RECORDS CUSTODIAN of the school district:
1. Shall provide the requested information or records to the governing board member not later than tEN business days after the administrator, official or records custodian receives the request.
2. May not require the governing board member to submit a public records request pursuant to title 39, chapter 1.
3. May not consider whether the requested information or records are relevant to any agenda item for an upcoming meeting of the school district governing board when reviewing and fulfilling a request for information or records pursuant to this subsection.
c. Each governing board member who receives information or access to records pursuant to this section shall maintain any confidentiality, privilege or privacy granted or imposed by statute or common law, including any requirements prescribed by the Family Educational Rights and Privacy Act of 1974 (P.L. 93-380; 88 Stat. 571; 20 United States Code Section 1232g). A governing board member who receives information or records relating to the discipline or proposed discipline of an employee or student of the school district pursuant to this section may not discuss or share the information or records except in an executive session as defined in section 38-431.If a governing board member receives information or records relating to the discipline or proposed discipline of an employee or pupil of the school district pursuant to this section may not discuss or share the information or records except in an executive session as defined by section 38-431. tHIS SUBSECTION DOES NOT PREVENT A GOVERNING BOARD MEMBER FROM disclosing information or sharing records with a law enforcement agency, a peace officer, the office of the auditor general or the state board of education relating to the governing board member's reasonable suspicion of unlawful conduct.END_STATUTE
