87R17661 ANG-D     By: Pacheco, Campos H.B. No. 3908     Substitute the following for H.B. No. 3908:     By:  Johnson of Dallas C.S.H.B. No. 3908       A BILL TO BE ENTITLED   AN ACT   relating to the deputy clerks appointed to certain statutory   probate courts.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 25.0173(g), Government Code, is amended   to read as follows:          (g)  The county clerk shall appoint a deputy clerk for each   statutory probate court.  [An appointment takes effect when it is   confirmed in writing by the judge of the court to which the deputy   clerk is assigned.]  A deputy clerk serves at the pleasure of the   judge of the court to which the deputy clerk is assigned.  A deputy   clerk must take the constitutional oath of office, and the county   clerk may require the deputy clerk to furnish a bond in an amount,   conditioned and payable, as required by law.  A deputy clerk acts in   the name of the county clerk and may perform any official act or   service required of the county clerk and shall perform any other   service required by the judge of a statutory probate court.  A   deputy clerk must attend all sessions of the court to which the   deputy clerk [he] is assigned.  [A deputy clerk is entitled to   receive an annual salary set by the judge in an amount that does not   exceed the amount paid the deputies of the county courts at law of   Bexar County.  The salary shall be paid in equal monthly   installments as provided by law for the payment of salaries of   deputy clerks.]          SECTION 2.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution.  If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect September 1, 2021.
