88R9851 LHC-D     By: Hull H.B. No. 3715       A BILL TO BE ENTITLED   AN ACT   relating to access to all prescribed medications by residents in   certain long-term care facilities.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subtitle A, Title 4, Health and Safety Code, is   amended by adding Chapter 226 to read as follows:   CHAPTER 226. LONG-TERM CARE FACILITY RESIDENT RIGHT TO ACCESS   PRESCRIPTION MEDICATION          Sec. 226.001.  DEFINITIONS. In this chapter:                (1)  "Long-term care facility" means:                      (A)  a facility licensed or regulated under   Chapter 242, 247, or 252, Health and Safety Code; or                      (B)  a state supported living center as defined by   Section 531.002, Health and Safety Code.                (2)  "Prescription" includes an entry in the   compassionate-use registry established under Section 487.054.          Sec. 226.002.  RESIDENT RIGHT TO ACCESS PRESCRIPTION   MEDICATION. A resident of a long-term care facility has a right to   access any medication for which the resident has a prescription   from a licensed practitioner, including a medication containing   low-THC cannabis.          SECTION 2.  This Act takes effect September 1, 2023.
