By: Menéndez, Paxton  S.B. No. 769          (In the Senate - Filed January 13, 2025; February 7, 2025,   read first time and referred to Committee on Education K-16;   April 10, 2025, reported adversely, with favorable Committee   Substitute by the following vote:  Yeas 10, Nays 0; April 10, 2025,   sent to printer.)Click here to see the committee vote     COMMITTEE SUBSTITUTE FOR S.B. No. 769 By:  Parker     A BILL TO BE ENTITLED   AN ACT     relating to a report by the Texas Higher Education Coordinating   Board regarding enrollment and success in higher education for   students with disabilities.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter C, Chapter 61, Education Code, is   amended by adding Section 61.06642 to read as follows:          Sec. 61.06642.  REPORT REGARDING ENROLLMENT AND SUCCESS IN   HIGHER EDUCATION FOR STUDENTS WITH DISABILITIES. (a) In this   section, "student with a disability" means a student covered under:                (1)  the Americans with Disabilities Act of 1990 (42   U.S.C. Section 12101 et seq.); or                (2)  Section 504, Rehabilitation Act of 1973 (29 U.S.C.   Section 794).          (b)  Not later than September 1, 2027, the board shall   prepare and submit to the legislature a report on enrollment and   success in higher education for students with a disability.          (c)  The report must identify, to the extent practicable:                (1)  the number and percentage of students with a   disability who enroll in an institution of higher education or   private or independent institution of higher education;                (2)  barriers to enrollment in higher education for   students with a disability;                (3)  policies of institutions of higher education or   private or independent institutions of higher education that   promote enrollment and success in higher education for students   with a disability;                (4)  what services and accommodations for students with   a disability are provided for accessibility at institutions of   higher education or private or independent institutions of higher   education;                (5)  what institutions of higher education or private   or independent institutions of higher education do to provide to   students with a disability sufficient and accurate information   regarding the educational rights and protections for persons with a   disability under state and federal law; and                (6)  any recommendations for legislative or other   action.          (d)  An institution of higher education shall provide to the   board on request, and the board may request from a private or   independent institution of higher education, any information   necessary for the board to prepare the report.          (e)  This section expires September 1, 2028.          SECTION 2.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution.  If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect September 1, 2025.     * * * * *
