85R2205 MEW-D     By: Schaefer H.B. No. 2874       A BILL TO BE ENTITLED   AN ACT   relating to providing information regarding immunization   requirements for admission to public elementary and secondary   schools.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 38.019, Education Code, is amended by   amending Subsections (a) and (a-1) and adding Subsections (c) and   (d) to read as follows:          (a)  A school district that maintains an Internet website   shall post prominently on the website:                (1)  a list, in English and Spanish, of:                      (A)  the immunizations required for admission to   public school by rules of the Department of State Health Services   adopted under Section 38.001;                      (B)  any immunizations or vaccines recommended   for public school students by the Department of State Health   Services; and                      (C)  health clinics in the district that offer the   influenza vaccine, to the extent those clinics are known to the   district; and                (2)  a direct link to the Department of State Health   Services Internet website where a person may obtain information on   exemptions from immunizations required for admission to an   elementary or secondary school as provided by Section 38.001,   including [relating to] the procedures for claiming an exemption   from the immunization requirements [of Section 38.001].          (a-1)  The link to the Department of State Health Services   Internet website provided under Subsection (a)(2) must be presented   in the same manner, including the same font style and size, as the   information provided under Subsection (a)(1).          (c)  If a school district provides written notice or other   written information relating to immunizations required for   admission to an elementary or secondary school as provided by   Section 38.001, the district shall include:                (1)  specific information on exemptions from the   required immunizations; and                (2)  the direct link to the Department of State Health   Services Internet website described by Subsection (a)(2).          (d)  The information provided under Subsections (c)(1) and   (2) must be presented in the same manner, including the same font   style and size, as the other information provided on immunizations.           SECTION 2.  This Act applies beginning with the 2017-2018   school year.          SECTION 3.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution.  If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect September 1, 2017.
